European regulators need stronger powers to oversee crypto markets, ESMA said on September 30, according to Reuters. The watchdog’s proposals include the ability to order freezes of assets suspected of being linked to criminal activity.

The call concerns the tools available to supervisors. It is not an announcement that a new set of powers has already entered into force.

Licensing is only part of oversight

Authorising a business establishes an entry point for regulation. Ongoing supervision must also deal with how assets move, who controls them and what happens when a provider or transaction crosses a national border.

Powers need clear boundaries

For legitimate businesses, predictable procedures are useful too. Firms need to know which authority to contact and how to respond to a lawful instruction.
